Introduction





With the development of the civilization, the cruel actions become out of the society. People have more stress on Human Rights. In history, capital punishment was a cruel penalty for every country. In current society, many people think the death penalty is too cruel and not conform to human rights; governments should be abolishing the capital punishment. Actually, there have many countries start stopping execution and remove death penalty. Of cause, there have Abolitionists is represent there have many people think capital punishment is the necessity of a social policy that would maintain the society to function properly without any problems. The people from different countries have different opinion. In this blog, I will represent “What is capital punishment?”, “Why there have some people think Capital Punishment need to be abolished?”, “Is the capital punishment debate conform to the human rights?”, “Should there be have a capital punishment?” to make people to think about the capital punishment‘s reasonable and necessity. My argument is capital punishment debate is the trend in the future, but in current society the death penalty is necessary for many countries.

What is Capital Punishment/Death Penalty?




Capital punishment is the execution of an offender sentenced to death after conviction by a court of law of a criminal offense. Death penalty should be distinguished from extrajudicial executions carried out without due process of law.

The theories of death penalty function are retribution and prevention. In current society, people need to get a heavy crime for them to get a death penalty.Alpha The punishment is a "damage" which lies in the middle of moral and juridical reaction to the wrong committed with the crime and it is known as a moral chastisement, not as revenge. Every death row inmate have damage one or several people’s human right no matter to direct or indirect. They need proportionate punishment to crimes. These issues are about “retribution”. “Death penalty is very cruel, and it can deter crimes” this argument is logically, and statistically well-based fact for capital punishment. According to capital punishment has deterred crimes and makes people to avoid crime, there shows death penalty has a preventive function against organized criminality.

Why there has some people think Capital Punishment need to be abolished?


There have some organizations want to annul the death penalty. They used two kind arguments which are Philosophical arguments and Practical arguments to support their discussion. The philosophical arguments are about “the offenders should have their human right”, “life is priceless, even though murderer’s life is the same.” The Practical arguments are about “If there have a miscarriage of justice, there cannot retrieve”, and “The prevent/deterrent function of the capital punishment has not work, the crime rate haven’t deterred by capital punishment”, “the cost for the capital punishment has spend too much money”

Is the capital punishment debate conforming to the human rights?



Human rights is the major argument to make people oppose capital punishment. Human rights are defined as any fundamental right that human must have such as need for food, and safety. They included civil and political rights, such as the right to life, equality before the law and freedom of expression....etc. The Abolitionists think every human’s life is priceless, even though the murderers. No one can deprive their right to life. So they think capital punishment is unreasonable. Human rights entail both rights and obligations. At the individual level, while we are entitled our human rights, we should also respect the human rights of others. The supporters think every murderer has been disregarding victims’ right to life; they don’t have authority to protect by human rights. Right to life means having intrinsic value and worth. Before a person commits murder, he/she is acting rationally knowing in advance the consequences of his/her actions; therefore he/she loses his right to life. A person also loses his/her right to life if he/her chooses to do so. Human rights law does not prohibit the use of the death penalty as a punishment for crimes but it does encourage its abolition and seek to limit its use. There have some people think imposition of capital punishment would not cause the violation of human rights. It would protect the wider range of human-rights violations instead by protecting the lives of many innocents. There have an example from an article; the author heard news, a 62 year-old grandmother, Betty Beets, had five husbands. She had already killed the fourth one, and served a prison sentence for murder, and she got out of prison early. She murdered the fifth husband by shot him, and buried him in her back yard. In the case, cause of the government excuse Betty Beets, and then make an innocent person die by the murderer. Is it conforming to the human rights? It doesn't protect other people’s safety.


Should there be have a capital punishment?


Capital punishment is necessary for many countries. There have more countries decided to stop execution and remove death penalty. The capital punishment debate is become the trend. Many Abolitionists said “the crime rate haven’t decrease by execution, the capital punishment’s deterrence function have doesn't work.” to support their discussion. Actually, some countries’ crime rates haven’t increase after capital punishment debate. Abolitionists cannot use those data to request other countries to abolishing the death penalty. Every country has their different culture, educate environment, values. For example: in china, people have traditional concepts which like “a murderer must repay with his life”, and “people need response the effect when they do something.” In this situation, if China stops execution, this may cause many problems to make the society function properly. How can we do that? The capital punishment debate is the trend for future, but it doesn't mean abolishing is fit to some countries. The capital punishment is necessary punishment for many countries.



Conclusion

In now’s society, there are laws to protect teenagers. Some teenagers use these laws to protect them and do many crimes. The law is for protecting teenagers’ right, and it becomes an accomplice which helps teenagers to crime. Human right is a good concept, but everything should have a limit. If murderer’s right to life will destroy other people’s right to life, death penalty is the worst/ best choice. Capital punishment is not a good punishment, but sometime it is necessary and conforming.
